Welcome to Marmee Beauty. These Terms of Service ("Terms") govern your access to and use of marmeebeauty.com (the "Site") and your purchase of our products. By accessing the Site or placing an order, you agree to be bound by these Terms. Please read them carefully.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase, or have the involvement of a parent or legal guardian. By placing an order, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Your account

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Products and descriptions

We strive to display our products, ingredients, and colors as accurately as possible. Actual packaging and colors may vary slightly from images shown on your screen. Marmee products are cosmetic hair- and scalp-care items intended for external use only. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease. Always read the label and ingredient list, and patch-test before first use.

4. Pricing, orders, and payment

• All prices are listed in U.S. dollars and are subject to change without notice.
• Placing an order is an offer to purchase. We may accept or decline any order, and we reserve the right to limit quantities, correct pricing or typographical errors, and cancel orders — including after an order confirmation has been sent — for reasons such as suspected fraud or stock issues.
• Payment is charged at checkout through our third-party payment processors. You represent that you are authorized to use the payment method provided.
• Applicable sales tax is calculated at checkout based on your shipping address.

5. Subscriptions and auto-renewal

If you enroll in a subscription ("Subscribe & Save" or similar), you authorize us to charge your payment method automatically on the recurring schedule and at the price disclosed at sign-up, until you cancel. You may skip, reschedule, pause, or cancel through your account or by contacting support before your next billing date. Changes take effect on future orders. We will notify you of material changes to subscription pricing.

6. Promotions, discounts, and gift cards

Promotional codes and offers are subject to their stated terms, cannot be combined unless noted, have no cash value, and may be modified or withdrawn at any time. Gift cards are non-refundable and cannot be redeemed for cash except where required by law.

7. Shipping and returns

Shipping timelines, rates, and options are described in our Shipping Policy. Returns, refunds, and our 30-day guarantee are described in our Return & Refund Policy. Both are incorporated into these Terms by reference.

8. Intellectual property

All content on the Site — including the Marmee Beauty name and logo, text, graphics, product photography, and design — is owned by or licensed to us and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

9. Reviews and user content

If you submit reviews, photos, or other content, you grant Marmee a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content in connection with our business, including marketing. You represent that your content is truthful, is your own, and does not violate any third-party rights. We may remove content at our discretion.

10. Prohibited uses

• Using the Site for any unlawful purpose or in violation of these Terms.
• Attempting to gain unauthorized access to the Site, other accounts, or our systems.
• Interfering with or disrupting the Site, including introducing malware or scraping data without permission.
• Reselling our products without authorization or misrepresenting your affiliation with Marmee.

11. Medical disclaimer

Our products are cosmetics, not medical treatments. Individual results vary. The information on our Site is for general educational purposes and is not medical advice. If you have a scalp or skin condition, allergy, or are pregnant or nursing, consult a qualified healthcare professional before use. Discontinue use if irritation occurs.

12. Disclaimer of warranties

The Site and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

13. Limitation of liability

To the fullest extent permitted by law, Marmee Beauty and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Marmee Beauty from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party right.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute not resolved informally will be handled in the state or federal courts located in Florida, and you consent to their jurisdiction. Where permitted, disputes may be resolved through binding individual arbitration, and you and Marmee waive the right to participate in a class action.

16. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Marmee regarding the Site.

17. Changes to these Terms

We may update these Terms at any time. Changes take effect when posted, and your continued use of the Site constitutes acceptance of the revised Terms.
